What sentence would you or I get if we were twice the legal limit and we crashed into another car killing a 16 year old boy?

I suspect it would be more severe than 7 month suspended sentence, which is what former Ireland and Munster rugby player Eddie Halvey got yesterday. He crashed into the back of a car, killing 16 year old Kevin Walsh. His mother said yesterday:

It sent out the wrong message to everyone in Ireland today. Go out, play sports for Ireland, drink drive, you can kill someone and you won’t get punished in court for it, that is the reality.

We are disappointed. He got a slap on the wrists for drink-driving and killing my child

And how right she is. Halvey apologised in court yesterday. How big of him. From the Irish Times:

Former rugby international Mick Galwey spoke on behalf of Halvey, saying that he was remorseful and was now a different man.

So fucking what? Of course he’s sorry. Unless he’s a robot why wouldn’t he be sorry? But it’s hard to look beyond the fact that he has been treated differently because he’s a rugby boy, one of the lads, and sorry doesn’t change the fact he killed a 16 year old lad with his car.

In February of this year a Latvian man was sentenced to 7 years in jail for drunk driving and causing the death of a Cork woman.

In November last year a Dublin man was jailed for 8 years for drunk driving and causing the deaths of two French women.

Last July a Carlow man was jailed for four months for driving while drunk and not having insurance.

In June a Dublin woman was described as menace and jailed for 6 years for drunk driving and injuring a pedestrian.

In April a Bray man was jailed for 6 months for drunk driving and driving without insurance.

Also in April an Enniscorthy man was jailed for 8 months for drunk driving.

The list of cases goes on and on. Yet this rugby player gets 7 months suspended for causing the death of a 16 year old boy.

It’s not right, is it?

    Lot of conspiracy theories and lazy stereotyping here. The sentence is extremely lenient, this has dragged on for 3 years amid whispers of mitigating circumstances. Judging by the sentence ther seems to have been some. Sentencing has nothing to do with who he is, just a good defence team.

    - Anabels: Four posh boys with no previous convictions kill one of their contemporaries. Get quite lenient sentences. Media uproar all through the trial. Constant focus on their upbringing/backgrounds with the emphasis that they should have known better etc.

    - New Ross: Eight working class dudes from tough estates and a prior reputation for being pricks kill a Swedish flower seller. I know this because I grew up there. Get even lighter sentences. No media uproar bar cursory reporting of the case. No focus whatsoever on their backgrounds.

  36. PME, on the same day that the Annabel 4 were being nudged gently and relatively unpunished into the grateful arms of their rich daddies, 5 young men from Inchicore were being given sentences ranging from 3 to 6 years for breaking into a pharmacy at night.

    Now, I believe that the pharmacy 5 got what they deserved,and the pop-collared pre-law cocksuckers of D4 got off lightly. I don’t need a media uproar to tell me right from wrong. Apparently you do.

    Incidentally, bocktherobber.com has yet tom comment on the drunk-driving member of the Munster Old Boy Fraternity. Funny that because he usually gets upset about anything.

    @ halvey – apparently there was a fuck-up on the scene of the crime stuff, sort of, and the DPP thought it might fuck up the case – unprompted???
    So the DPP says he’s dropping the case, local reaction makes him ‘re-think’ i.e. plea bargain, Halvey pleads guilty to lower charge, compliant judge, and there you are….Irish justice 2009 version.
